In Flanders, the reuse of excavated material is regulated by chapter VIII of the Decree on Soil Remediation and Soil Protection and chapter XIII of Vlarebo. With a few exceptions, it is compulsory to have a soil expert produce a technical report that determines the environmental quality of any material before it is transported to another location.
RSK Benelux is a type II certified soil expert. We can produce a technical report that identifies the potential options for material reuse. We are a member of two certified soil management organisations in Flanders that can track the transport of soil and excavated materials. Brussels capital region
A technical note regarding soil remediation from March 2009 regulates the reuse of excavated soils in soil remediation projects in the Brussels capital region. Strictly speaking, this regulation is limited to soil remediation projects, but IBGE/BIM strongly advises that the same rules be applied to all civil projects.
Soil and groundwater management reports (Gestion des terres et eaux souterraines pollués/Beheersvoorstel van verontreinigde gronden en groundwater) give the site user or owner certainty that no new contaminants are being created in these civil projects. Only certified soil experts are allowed to perform these investigations. RSK Benelux is a certified soil expert within the Brussels capital region for this type of work.
There is no specific legislation regarding the reuse of soil in the Walloon region, but related waste legislation does apply. RSK Benelux is a certified expert in the region and well placed to advise project developers, site users and/or owners on the management of soil and other materials within their civil projects.
